Nakładem wydawnictwa Brill ukazała się drukowana wersja książki pt. Impact of the COVID-19 Pandemic on Justice Systems: Reconstruction or Erosion of Justice Systems - Case Study and Suggested Solution p[od redakcją prof. K. Gajdy-Roszczynialskiej. W ramach zbioru poświęconego wpływowi pandemii Covid-19 na systemy wymiaru sprawiedliwości znalazł się mój artykuł pt. Organisation of the Civil Proceedings in Poland against the Pandemic. Omawiam w nim najważniejsze instrumenty procesowe mogące służyć rozpoznawaniu spraw cywilnych w dobie pandemii.

Recently, Polish legislator undertook a major change of the Polish Code of Civil Procedure (CCP) provisions by implementing the Act of 4 July 2019. The Act has been generally in effect since 7 November 2019. It is a fundamental change for the course of the fact-finding proceedings both before first-instance courts and second-instance courts.

There have also been major changes in terms of the organisation of the civil proceedings, particularly in relation to the preparation of the case for the review (including but not limited to the mandatory statement of defence and the preparatory meeting) and the new role of the court as a kind of “manager” of the proceedings (it is referred to as the case management in the legal science). Even though the amendments implemented in 2019 were not related to the COVID-19 pandemic, the pandemic was a real test for the procedural solutions that were implemented – it proved their benefits and revealed their shortcomings.

On the other hand, the pandemic also led to a change in our perception of the principal procedural rules and the existing procedural solutions. In particular, there arose a need to consider the possibility of using the existing solutions under procedural law in order to mitigate the negative effects of the pandemic. The changes made in 2019 have also provided a good opportunity to do so, and there are multiple new solutions which require a separate in‑depth analysis from that perspective.

The purpose of this paper is to point out to new mechanisms relating to the organisation of the proceedings which could be of use when alleviating the consequences of the pandemic for the civil proceedings. It is also to determine whether or not those
