W dniu 15 maja 2020 r. uczestniczyłem w konferencji (ZOOM webinar) pt. Covid-19 and civil justice organizowanego przez Panią prof. Catherine Piche z Uniwersytetu w Montrealu. Jest to pokłosie projektu naukowego pod tym samym tytułem.
Celem konferencji było udzielenie odpowiedzi na pytanie o sposób postępowania ze sprawami cywilnymi po ustaniu stanu epidemii, w szczególności sposobów radzenia sobie z przewidywaną ogromną liczbą spraw sądowych ( w tym głównie spraw rodzinnych, pracowniczych, gospodarczych).
W konferencji wzięli udział przedstawiciele kilkunastu państw z całego świata. Główne pytania postawione referentom były następujące:
- How (do) should courts in your country manage the current overflow of COVID-related litigation (and abusive litigation, relative to insurance, breach of contract, etc, and in the form of class actions or non-class, traditional litigation) and/or how will they manage the coming flow of litigation?
- To your knowledge, have legislators, court administrators, judges and/or practitioners worked on regulations, directives, legislations or other measures to structure the judicial response to this litigation in light of access to justice objectives?
- Have procedural rules in your country been adapted for the crisis/pandemic, and if so, how?
- Have virtual courts been used successfully to adjudicate in your country?
W najbliższym czasie ukaże się sprawozdanie z tego wydarzenia.
